Involuntary Conversions to Chapter 11. The 8th Circuitaffirmed the involuntary conversion of a voluntary, no-asset, individual Chapter 7 case to one underChapter 11. (In re Schlehuber) What should you do if faced with a similar action by a creditor or the USTrustee? The panel will review the applicability of Thirteenth Amendment involuntary servitude restrictions,how to make and preserve a constitutional challenge before the Bankruptcy Court, the standards for §706(c) conversions, and how best to defend these actions, as well as how handling such a case inChapter 11 may differ from an ordinary individual Chapter 11 case.
